These Terms of Use constitute a legal contract between Fleurieu Wellbeing Pty Ltd and You. Please read them carefully as they contain important information. By booking and making the payment, you will enter into a legally binding contract with us. Fleurieu Wellbeing runs this service. For a description of our services and details of how your privacy is respected, refer to our website and the Privacy Policy.

Cancellations

Non-attendance will not be refunded, and cancellations of less than 48 hours will be invoiced; however, you can reschedule a missed appointment provided notice is given 48 hours before your appointment requesting to reschedule.

Limitations of Services

Whilst there are many benefits to counselling services, there are limitations to the services. If at any time you believe that the counselling service does not meet or address your needs or gives rise to other concerns about your health, you are advised to seek the services of an appropriate healthcare professional. The services on this website will not be appropriate if:

• you are in a crisis situation – please call Lifeline on 13 11 14 for crisis support and suicide prevention;

• your personal safety is an issue – please call 000 for assistance.

Legal Jurisdiction

The services listed on this website are provided in accordance with laws and health practice standards in South Australia, Australia.

Termination of Services

You or We may terminate the counselling services at any time. Neither you nor We must give the other a reason for doing so.

Privacy

We will treat Your information in accordance with our Privacy Policy. We will comply with our obligations towards You under the Privacy Act 1988 (Cth) and the Freedom of Information Act 1991 (SA). We do our best to protect counselling e-mails from security breaches. However, email and web forms are transmitted through the internet and are therefore at risk of being intercepted, read or modified by third parties. Telehealth counselling using videoconferencing programs is limited to the security of each program, which may again be at risk of third-party compromise. We use the best available telehealth service provider to provide our telehealth services. In-person services are treated in exactly the same way, ensuring your privacy is protected.

Recordings

We will not record any voice or video interaction with You without notifying you of such recording at that time. Should this occur, we will deal with such recordings in accordance with our Privacy Policy.

Emails

Fleurieu Wellbeing will respond to your contact based on the information that you provide. To ensure that we have all the relevant information, the counselling practitioner may need to ask you some more questions to clarify your situation or concerns. This may occur via a follow-up email or telephone call.

Frequency

The frequency of contact and the time frame for response to emails will be negotiated between You and the counselling practitioner during initial contact, subject to the availability of the counselling practitioner.

Age

Fleurieu Wellbeing is a Registered Child Safe Provider with the Department of Human Services. Legal guardian consent is required for services to anyone under the age of 18. For children 9 years and under, please contact your state's Early Childhood Intervention Provider. Young persons receiving NDIS or Carer Services funding are eligible for all services.

Your Conduct

When using counselling services, you have responsibility for:

• Conducting your communications with a counselling practitioner in a way that will maximise your ability to benefit from it (e.g., not being under the influence of drugs or alcohol). Also, act in accordance with our behaviour policy, which can be found in the FAQs section of our website.

• Provide the counselling practitioner with relevant information about your circumstances and participate in your agreed plan, which may include evidence-based interventions to enable you to benefit most from your service.

Varying these terms of use

We may vary these Terms of Use from time to time by notifying you by email and requiring you to agree to the varied Terms of Use. If you do not agree to the varied Terms of Use, we may decline to provide further services to You.

Applicable law

This agreement is governed by the laws of South Australia, Australia, and you agree that the courts and tribunals of South Australia and the federal courts of Australia (South Australian registry) will be appropriate jurisdictions for resolving any disputes.
